Elders Parole Program + Letter

In 2022, Jimmy’s family reached out to the California Board of Parole Hearings regarding Jimmy’s eligibility for the Elders Parole Program. The requirements for this program are to be continuously incarcerated for 20 years and to be over the age of 50. As of July 2024, Jimmy will be 60 and will have been incarcerated for 42 years.

The Board responded to his family’s inquiry with the letter below, stating that he is not eligible due to his “second strike violation”, referring to the assault charge. This rejection does not account for his wrongful conviction and the unjust circumstances behind his assault charge.
